Access to Schengen

 

The Schengen Information System (SIS) concerns you directly, whether you are national of a Schengen Member State or not.

 

If you have reason to believe that your name appears in the SIS, do not hesitate to exercise your rights.

 

In Portugal, the right of access, correction or deletion, regulated by Act 2/94, of 19 February, and is exercised by means of the CNPD.

 

Therefore, you shall address your request to the CNPD , by using the following forms:

Attention: It is essential that you enclose to your request an intelligible authenticated copy of your passport, and if applicable, an authenticated copy of your residence permit as well.

We provide here a non-official translation of the forms to help you in the fulfilment. However, you shall use the Portuguese version of the application forms, fulfilled in Portuguese. All the documents presented to the CNPD have to be translated into Portuguese.

 

Know your rights

 

The Schengen Convention itself recognises the rights of individuals.

These include:

 

  • The right to access information (alert) concerning you which is contained in the SIS;

  • The right to correct data where there is a de jure or de facto mistake;

  • The right to apply to the courts or competent authorities to demand that data be corrected, deleted or that damages be awarded;

  • The right to ask for data to be checked and to question the use made of such data

 

 

You may check your alert in the SIS in any Schengen Member State. The checks will be carried out in accordance with national legislation that applies in that Member State. For further information, you may consult the Guide to exercise your rights
